Blockchains and Online Dispute Resolution: Smart Contracts as an Alternative to Enforcement

The prolific rise of cross-border transactions, e.g. e-commerce, is rapidly changing both dispute resolution and enforcement. The dominance of the Internet means that individuals are more often entering into contractual relations regardless of geographical locations or jurisdictional boundaries. Undoubtedly, the increase in online transactions has also caused an upsurge of disputes; in order to preserve consumers’ trust in the online market, such disputes need to be resolved. However, these disputes, which are characterised by their low intensity nature, seldom surpass the relatively high threshold of cross-border litigation in public courts, leading to the development of alternative methods of conflict management, namely online dispute resolution (ODR).
